Another controversial decision of United States President Donald Trump has now come under the court’s radar. The U.S. Ninth Circuit Court of Appeals has declared his presidential order, which was issued to abolish birthright citizenship, unconstitutional. This decision was given by a bench of 3 judges, out of which 2 judges voted against this order and 1 supported it.

In its decision, the Court clearly wrote, “This presidential order violates the 14th Amendment to the Constitution of the United States. The Constitution provides that all persons born in the U.S. or legally naturalized here are entitled to full American citizenship.

Trump signed this order on January 20 the day before he became president. On this day, he made several bold and strict decisions regarding immigration policy, and the issue of birthright citizenship was a major agenda for him.

Trump said that immigrants, especially illegal immigrants, obtain automatic citizenship simply by giving birth to children in the U.S. and that this loophole must be closed. But civil rights organizations and legal experts immediately challenged the decision, saying that the President issuing such an order is against the Constitution.

Multiple lawsuits were filed against the order, involving several states. Courts had previously stayed the order, but now the Ninth Circuit has formally declared that the order is not lawful. This is the first time a federal appeals court has taken a clear stance on the issue.

The 14th Amendment is a fundamental part of the U.S. Constitution, which clearly states that “All persons born or naturalized in the United States are citizens of the United States.” This means that anyone born in America whether their parents are immigrants or not will be a citizen of the U.S.

This principle is called “birthright citizenship” and is a core part of American values. Trump’s order directly challenged this principle, which the court has now rejected.
